Chelsea penalized for financial misconduct: Not yet a disaster

Chelsea's £10.75 million fine for opaque payments is a record amount. However, compared to another legal case involving Chelsea seven years ago, they still consider themselves fortunate.

The nature of the two cases is, of course, completely different. In 2019, Chelsea was fined £460,000 by FIFA and received a transfer ban for that summer season due to violations related to the registration and transfer of 29 players under 18 years old.

High fine, but still allowed to transfer

What about this recent case? The fine is much larger: £10.75 million. They are banned from recruiting any players for their academy for nine months. This means Chelsea cannot sign young players who have been registered with any Premier League club or other English team in the past 18 months. This ban does not apply to players already attached to Chelsea's academy seeking to formalize their professional contracts or those first registering for Chelsea's academy at the U9 level. Fortunately, Chelsea's one-year first-team transfer ban is "suspended" for a 24-month period instead of being immediately effective as it was seven years ago. This means they retain the right to make purchases in the upcoming summer transfer window. Additionally, Chelsea does not face any point deductions.

What led Chelsea to receive such penalties? It stems from £47.5 million in illicit costs spanning eight years during the Abramovich era. More specifically, Chelsea paid £23 million to seven unregistered agents to help the Blues recruit top names like David Luiz and Eden Hazard. These were key players who contributed significantly to Chelsea's successive successes under Abramovich from 2010 until his departure as owner in 2022. Additionally, £19.3 million was paid to two entities to facilitate the recruitment deals for Willian and Samuel Eto'o. The remaining two payments by Chelsea were £3.8 million to recruit an undisclosed young player and £1.4 million to pay former sporting director Frank Arnesen, former scout Piet de Visser, and an unnamed individual.

These payments are believed to have been directed to third-party entities, primarily operating in the British Virgin Islands. This location is still considered an ideal tax haven. Chelsea avoided sporting penalties due to two factors: the "self-cooperation" spirit from Boehly and Chelsea's new leadership in reporting the predecessor's misconduct, and the illicit funds did not cause Chelsea to breach the Premier League's Financial Sustainability Rules (PSR). The £10.75 million fine remains relatively light compared to the immense profits generated by players like Hazard, Luiz, and Willian through helping Chelsea secure titles.

What awaits Chelsea next?

Looking at the period during which Chelsea had opaque payments, many wonder why the Blues' case took so much time and the penalty was lighter than expected. Some believe Chelsea is being treated entirely differently compared to the cases of Nottingham Forest and Everton. One explanation lies in their self-reporting of the violations to the Premier League and cooperating openly. This significantly mitigated Chelsea's punishment. The Blues themselves confirmed providing thousands of documents to the Premier League's investigation: "Chelsea welcomes the Premier League's acknowledgment of this cooperation."

Chelsea itself is not unfamiliar with financial penalties. Besides the 2019 transfer ban mentioned earlier, Chelsea was fined £8.64 million by UEFA in July 2023 for incomplete financial reporting in 2018 and 2019. Currently, the Blues are suspected of being involved in 74 FA charges related to agents and third parties spanning from 2009 to 2022.

All will look at Chelsea's case as a reference material to envision what might happen to Manchester City. The blue half of Manchester faces 130 charges, and there is still no official confirmation on when conclusions for these charges will be finalized.

What Chelsea can feel fortunate about is that their plans for the next season will not be severely affected. For now, Rosenior and his team have much work to do, including striving to secure a Champions League spot next season to ensure their financial situation is not heavily impacted.
